Rear brake light switch

seems my rear brake light swith has failed leaving light permanently on. I think that's a third one in as many years. It's disconnected for now and the front brake light is working fine. Is the rear brake light not wprking an MoT fail? what if I remove the switch? Anyone know a good switch to replace.
